Register and simply submit a photo of you wearing the TACKIEST sweater you own along with a short description of why you deserve to win. You can instead choose to submit a picture of your child under 18 years of age, as long as you are their parent or legal guardian.


HOW TO WIN

Contest Dates The CardSwap Ugly Sweater Contest will be accepting new entries up to 11:59 pm EST on January 31th, 2012. Voting on entries will remain open till 11:59 pm EST on February 14th, 2012.

Eligibility The CardSwap Ugly Sweater Contest is open to all legal residents of Canada, 18 years or older. Parents or legal guardian may instead submit a photo of their child. Limit one entry per person. Employees and affiliates of CardSwap and their respective household members may enter the contest but are not eligible to win any of the above prizes. Winner Notification Winners will be notified via the e-mail provided during registration within five (5) business days after the Contest closes. All winners will be required to correctly answer a skill testing question before being able to claim their prize.

1.      ELIGIBILITY

The CardSwap Ugly Sweater Contest (the “Contest”) is organized by CardSwap Inc. ("CardSwap" or “Sponsor”), and is open to all legal residents of Canada, 18 years or older (“Eligible Participants”).  Eligible Participants will have the option to submit either:      

a) a photograph of themselves, or

b) as legal guardian of a child under 18 years old, a photograph of their legal child.

 

Employees of CardSwap and their respective family and household members may enter the contest, but are not eligible to win any of the Prizes (defined below). 

 

 

2.      CONTEST PERIOD

The Contest will consist of two (2) phases:

a.       Entry Period:  Eligible participants can submit a picture and accompanying descriptions (“Entry”) for consideration in the Contest. This will run from 12:00 am on December 1st, 2011 through 11:59 pm on January 31st, 2012 (“Entry Closing Date”).  All times are Eastern Standard Times

 

b.       Public Voting Period:  Entries will be displayed online and members of the public will be given the opportunity to vote on their favourite Entries.  This will run from 12:00 am on December 1st, 2011 through 11.59 pm on February 14th, 2012 (“Voting Closing Date”).

 

 

3.      HOW TO ENTER THE CONTEST

a.       Eligible Participants must visit www.CardSwap.ca and either sign in or register to create a new user account.

 

b.       Once logged-in on CardSwap, visit www.CardSwap.ca/contest/uglysweater  (the “Contest Website”) to upload a photo and accompanying description (max 500 characters) on why you deserve to win. 

 

c.       Each photo:

§ must be in JPEG. PNG or GIF format;

§ shall NOT exceed 1 MB;

§ must be a horizontal shot with clear background;

§ may include more than one person ONLY if all other person in the photo are direct members of the family residing at the same address;

§ must be an original photo and must be your property;

§ must be appropriate for family viewing and present content that, at CardSwap's sole and entire discretion, is suitable for the public at large;

§ must not, at the sole discretion of CardSwap, contain scenes of a sexual nature, or scenes that are abusive, discriminatory, defamatory or in any way inappropriate;

§ must not, at the sole discretion of CardSwap, contain scenes of a commercial nature that promote products or services;

§ may be submitted only once;

§ must not contain works that are protected by copyright, other than those that belong to you.

 

d.      Eligible Participants may only submit one Entry.  Any attempt or suspected attempt to submit more than one (1) Entry, any use of robotic, automatic, programmed or any entry methods not authorized by these rules, shall be deemed as tampering and will void all of your Entries.  Entries that are incomplete, illegible, damaged, contain an erroneous email address or do not conform to or satisfy any condition of the rules may be disqualified by the Contest Sponsor, at the Contest Sponsor’s sole discretion. Eligible Participants who do successfully submit an Entry will thereafter be deemed a contest participant (“Contest Participant”)

 

e.      CardSwap will, but is under no obligation to, examine uploaded photos. If CardSwap, at its sole and entire discretion, determines that a photo includes content that does not respect the present rules or any other applicable condition, CardSwap reserves the right to remove the said photo, at its sole discretion and without further notice. The entrant whose picture is removed will receive a notice by email in this regard. The Contest Sponsor does not guarantee the order in which photographs will appear on the Contest Website. 

 

f.        Declaration of Consent Regarding Submitted Photo

ALL CONTEST PARTICIPANTS ACKNOWLEDGE AND AGREE THAT ALL ENTRY MATERIALS SUBMITTED IN CONNECTION WITH THIS CONTEST ARE SUBMITTED ON A NON-CONFIDENTIAL AND NON-PROPRIETARY BASIS AND MAY BE USED BY SPONSOR, AND AFFILIATES,  FOR ADVERTISING AND PROMOTIONAL PURPOSES INCLUDING (BUT NOT LIMITED TO) IN CONNECTION WITH THE PUBLIC ONLINE VOTING SITE DESCRIBED BELOW.

 

 

 

 

4.      CONTEST VOTING

a.      Upon submission of each Entry during the Contest Period, each photo included will be immediately posted on the Contest Website and open for voting by the public.

 

b.      To vote, visit the Contest Website at www.CardSwap.ca/contest/uglysweater, select the photo you wish to vote for, click “Vote” button and follow the instructions to submit your vote. For security purposes, voters who are not logged-in to CardSwap will be required to confirm the code appearing on the screen to submit their vote.

 

c.       Voters may submit up to ten (10) votes per day during the Public Voting Period.  Limit of one vote per Entry per day.  Votes may be submitted up until the Contest Closing Date. Voters may be required to enable cookies in their web browser to submit their votes.

 

d.      Contest Participants are encouraged to log-in to the Contest Website and vote for Entries from other Contest Participants.  For each vote while logged-in, the Contest Participant will automatically generate one (1) additional ballot for the Bonus Prize Draw (defined below).  Each Contest Participant is allowed to submit up to ten (10) votes per day during the Public Voting Period. Limit one vote per Entry per day

 

e.      All votes will be examined to cross reference the IP and email addresses in order to validate the integrity of the votes. Contest Sponsor reserves the right, at its sole discretion, to disqualify your Entry from the Contest Website when votes are or are suspected to be generated through the use of false email addresses or frequently repeated IP addresses and/or found to be supported by any robotic, automatic, or programmed voting system. For clarity, this includes the use of online voting boards or other similar vote generating platforms.

 

5.      PRIZES

a.      Grand Prize:  The Entry having obtained the most votes by the end of the Public Voting Period and the Contest Participant associated with such Entry will be deemed the eligible Grand Prize winner (the “Grand Prize Winner”) of the Contest. The Grand Prize Winner will receive gift cards for a total of $1,000 CAD to store(s) of his/her choice.  The Grand Prize Winner may select gift cards from up to five different retailers, as long as they have a physical store location in Canada. Minimum $50 CAD denomination for any selected retailer.  The total approximate retail value of this prize is $1,000 CAD.

 

b.       Bonus Prizes:   At the end of the Public Voting Period, all Contest Participants, excluding the Grand Prize Winner, will be eligible to win one of five $100 shopping spree bonus prize, comprised of a $100 gift card to any retailer with a physical store location in Canada (the “Bonus Prize”).  The winners will be selected based on a random draw where Contest Participants will receive one (1) ballot for each Vote their Entry received as well as one (1) ballot for each eligible Vote they submitted while logged-in to the Contest.   For clarity, Contest Participants who received and cast more votes will have a proportionately higher chance of winning, yet all Contest Participants will be eligible to win a “Bonus Prize”.

 

 

c.       Winner Notification:  The eligible winners will be notified by telephone and/or email within five (5) business days of the Contest Closing Date at the email address provided during Contest registration.  The eligible Grand Prize Winner will be the first to be notified and has to be confirmed the Grand Prize Winner before the other Prize winners will be contacted

 

d.      In the event an eligible Grand Prize Winner cannot be reached within five (5) business days following the first attempt of contact, incorrectly answers the skill-testing question, declines the prize, or fails to return a Release of liability as specified, he/she will have forfeited the right to claim the Grand Prize and the next Entrant who obtained the most votes will be the eligible Grand Prize Winner.

 

e.       To be declared a winner, the eligible winner must first correctly answer, unaided, a time limited, mathematical skill-testing question administrated by email or by phone; and must sign and return Declaration of Compliance with the Contest Rules and a full Liability and Publicity Release, and any other document that may be required. Eligible winner shall provide if requested by the Contest Sponsor, photo ID and proof of being the same individual as depicted in the Entry photo.

 

f.        All decisions by the Contest Sponsor or its representatives regarding the awarding of the prizes are final and without appeal.

 

6.      OTHER

a.       Prizes must be accepted as awarded and are not transferable, redeemable, refundable or exchangeable for cash. Contest Sponsor reserves the right to substitute a prize, or any portion thereof, with a prize of at least equal value in the event of the unavailability, for whatever reason, of the advertised prize.

 

b.       By entering this Contest and/or accepting a prize, Contest Participants consent to the use of their entry, name, city of residence and/or voice, statements, any photographs or other likenesses for publicity, advertising or informational purposes carried out by the Contest Sponsor and/or its affiliates in any medium or format without further notice or compensation.

 

c.       The Contest is subject to all applicable federal, provincial and municipal laws and regulations.

 

d.       No communications will be entered into except with selected Contest Participants. Visit www.CardSwap.ca after the Contest Closing date to know the name of the winners. Name of winners will be posted within 2 or 3 weeks of the Contest Closing Date.

 

e.       Odds of winning depend on the number of eligible Entries and the number of votes submitted for each Entry. Contest Sponsor takes no responsibility for lost, delayed, damaged, misdirected, late or destroyed Entries, or for typographical or other production errors. Contest Sponsor is not responsible for any errors or omissions in printing or advertising this Contest. All Entries submitted become the property of the Contest Sponsor (except for the photos included in the Entry).

 

f.        By entering this Contest, entrants release and hold harmless the Contest Sponsor, including its employees and affiliates, from any liability in connection with this Contest or, if declared a winner, the prizes.

 

g.       This Contest will be run in accordance with these rules. Contest Participants must comply with these rules, and will be deemed to have received and understood the rules by participating in the Contest. The terms of this Contest, as set out in these rules, are not subject to amendment or counter-offer, except as set out herein.

 

h.       Contest Sponsor assumes no responsibility for failure of the internet or the website during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant's or any other person's computer related to or resulting from playing or downloading any material in the promotion. Contest Sponsor reserves the right to cancel or suspend this Contest should a virus, bug or other cause beyond their reasonable control corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws. Should such an attempt be made, Contest Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

 

i.         If the identity of an entrant is disputed, the authorized account holder of the e-mail address submitted at the time of entry will be deemed to be the Contest Participant. The individual assigned to the-mail address for the domain associated with the submitted e-mail address is considered the authorized account holder. A selected Contest Participant may be required to provide proof of being the authorized account holder of the e-mail address associated with an entry. All entries must be submitted from a valid e-mail account. The sole determinant of time for the purposes of receipt of a valid entry/vote in this Contest will be the contest server machine(s).

 

j.         This Contest is governed by the rules and regulation of the Province of Ontario.  

 

k.       If any of the above Rules of the Contest she be determined by any court or competent jurisdiction to be invalid and unenforceable to any extent, the remainder of the Rules shall remain in effect and not be affected by such invalidity.
